Privacy Policy

A&C Notary Services is committed to protecting the privacy and security of the personal and sensitive information entrusted to us. This Privacy Policy describes how we collect, use, process, and protect your information in the course of providing our notarial services.

1. Information we collect:

We collect information necessary to perform our notarial duties, comply with state laws, and maintain proper business records. The types of personal information collected depend on the service provided (Traditional, Mobile, or Remote Online Notarization).


A. Information You Directly Provide

  • Identifying Information: Full legal name, residential address, email address, and phone number.
  • Identification Credentials: Data from a government-issued ID (e.g., driver's license, passport), including ID number, issuance date, expiration date, and photograph.
  • Journal Information: Mandatory legal entries in the Notary Journal, which may include the type of notarial act, date and time, type of document, signature, and method of identification.
  • Financial Data: Payment information (e.g., credit card details) necessary to process payments for services rendered (Note: We do not store full payment information; it is processed via a third-party payment processor).
  • Document Information: The documents being notarized, which often contain highly sensitive personal or financial information.


B. Information Collected During Remote Online Notarization (RON)

For RON services, in compliance with state laws, we collect additional information:

  • Video and Audio Recording: A recording of the entire notarial session.
  • Identity Verification Data: Results from Knowledge-Based Authentication (KBA) questions and credential analysis performed by the RON platform provider.
  • Metadata/Usage Data: Technical information about the session, such as IP address, operating system, browser type, and time stamps.


2. How We Use Your Information

Your personal information is primarily used for the following specific purposes:

  • To Perform Notarial Acts: To verify your identity, witness your signature, and accurately complete the notarial certificate and official Notary Journal entry as required by law.
  • Legal Compliance: To comply with all statutory and regulatory requirements for notaries public in the state of [Insert State, e.g., Nevada], including the retention of Notary Journals and RON session records.
  • Service Delivery: To communicate with you regarding appointments, service changes, and document status.
  • Billing and Payment: To process fees for services rendered.
  • Security and Fraud Prevention: To protect against fraudulent or unauthorized transactions and ensure the integrity of the notarial act.


3. Disclosure of Your Information

Due to the legal and official nature of notarial acts, we are limited in how we can share your information. We will never sell your personal information. We may disclose your information in the following circumstances:

  • To Required Third Parties: We may share necessary information with service providers who assist us in operating our business, such as:
    RON Platform Providers: For identity verification, session recording, and electronic seal application.
  • Payment Processors: To handle transaction payments securely.
  • As Required by Law: We must disclose information from the Notary Journal upon receipt of a lawful request, such as a subpoena, court order, or formal request from a government agency or the Notary Public's commissioning authority.
  • To the Public (Journal Entries): Under state law, certain information recorded in our Notary Journal may be subject to public inspection upon written request, though we are legally obligated to redact certain sensitive information (such as driver's license numbers) before disclosure.


4. Data Security and Retention

A. Security Measures

We implement appropriate physical, electronic, and administrative security measures to protect your personal information against unauthorized access, disclosure, alteration, and destruction. This includes:

  • Storing physical journals and documents in a locked, secure location.
  • Using secure, state-compliant platforms for all Remote Online Notarization sessions.
  • Employing encryption and secure protocols for digital data transmission.


B. Data Retention

We retain your personal information, including Notary Journal entries and RON session recordings, for the duration required by our state commissioning authority, which is 7 years, The Notary's Term, permanently after the date of the notarial act. After the mandatory retention period, records will be disposed of securely as required by law.


5. Your Privacy Rights

Depending on the state in which the notarial act is performed, you may have specific rights regarding your personal information, including:

  • Right to Access: The right to request a copy of the personal data we hold about you, subject to legal limitations.
  • Right to Correct: The right to request correction of inaccurate or incomplete data.
  • Journal Access: You have the right to request a certified copy of the specific entry in our Notary Journal that relates to your transaction, pursuant to state law.

1. Scope of Agreement

1.1. Purpose: This MSA sets forth the general terms and conditions governing the provision of Notary Public and administrative services ("Services") by A&C to the Client, which shall be requested via separate Work Orders or Service Authorizations ("SOAs").

1.2. SOAs: Each specific engagement will be documented in a separate SOA. All SOAs executed by the Parties shall be subject to the terms of this MSA. In the event of a conflict, the terms of the SOA shall prevail only to the extent of the conflict.

1.3. Services Provided: A&C Notary Services offers, and the Client may retain the Service Provider for the following independent services, all of which are subject to the specific terms set forth in this MSA:

* General Mobile Notary Work: Performing traditional, in-person notarial acts (Acknowledgments, Jurats, Oaths/Affirmations) at a location designated by the Client.

* Remote Online Notarization (RON): Performing notarial acts on electronic documents for a remotely located individual via approved audio-visual technology and RON platform, as permitted by Nevada law.

* Loan Signing Agent Services: Mobile service involving the printing, transportation, presentation, and notarization of loan document packages for mortgage, refinance, or other real estate transactions.

* Apostille and Document Authentication Services: Non-notary, administrative service involving the processing, submission, and courier delivery of documents to the relevant State authority (e.g., the Nevada Secretary of State) for the issuance of an Apostille or Certificate of Authentication.

* Field Inspection Services: Non-notary, independent contractor services including on-site property or asset verification, condition reports, and photographic documentation on behalf of the Client.

2. Term and Termination 

 2.1. Term: This Agreement shall commence on the Date of Service on Quote/Invoice and shall remain in full force and effect throughout the duration of the client/business relationship between A&C Notary Services and the Client ("Term").

This MSA shall govern all Services requested by the Client during the Term.

2.2. Amendments and Revisions: A&C Notary Services reserves the right to amend or revise this MSA at any time. Any changes or revisions to this Agreement shall be provided to the Client in writing at least thirty (30) days prior to the effective date of the change. Continued use of A&C Notary Services by the Client after the effective date of the amendment constitutes acceptance of the revised terms.

2.3. Termination for Convenience: Either party may terminate the business relationship and this Agreement for any reason immediately to the other party.

2.4. Effect of Termination: Termination of this MSA shall not relieve either Party of any obligations arising before the effective date of termination, including payment obligations for services rendered under any active SOAs.

3. Authority, Disclosures, and Service Requirements

3.1. NON-ATTORNEY DISCLOSURE (REQUIRED BY NV LAW): A&C Notary Services is not an attorney authorized to practice law in the State of Nevada and is prohibited from providing legal advice or legal representation to any person. A&C is an impartial witness to the signing of documents.

3.2. Limitation of Duty: A&C’s duties are strictly limited to the execution of the notarial act, including verifying the identity of the signer, witnessing the signature (where required), and completing the notarial certificate.

3.3. Signer Requirements (General): The Client understands and agrees that A&C will require every signer to present valid, government-issued photo identification as required by Nevada law and to sign A&C’s Notary Journal.

3.4. Refusal to Notarize: A&C reserves the right to refuse a notarization if, in its professional judgment, the signer appears coerced, is not of sound mind, or lacks proper identification, as required by Nevada Revised Statutes (NRS) Chapter 240.

3.5. Business License: A&C Notary Services is a duly licensed business operating in the State of Nevada and Clark County/City of Las Vegas], holding all necessary permits and licenses to conduct its business activities

3.6. Bond and Insurance: A&C maintains a Notary Public Surety Bond as required by Nevada law and carries Errors & Omissions (E&O) insurance coverage of $100,000.

3.7. Remote Online Notarization (RON) Requirements

If Services are provided via Remote Online Notarization (RON), the following additional terms apply:

  1. Approved Platform: A&C shall use a RON platform registered and approved by the Nevada Secretary of State for all RON Services.
  2. Notary Location: A&C shall be physically located within the State of Nevada at the time of performing any RON session, regardless of the Signer’s location (NRS 240.1993).
  3. Recording: The entire RON session shall be recorded via audio-visual means and retained by A&C or the approved RON platform for the minimum period required by Nevada law.
  4. Identity Verification: The Signer must successfully pass multi-factor authentication, including Credential Analysis and Identity Proofing (KBA), as required by Nevada law. Failure to verify identity will result in immediate termination of the session.
  5. Technical Requirements: The Signer is responsible for providing a reliable internet connection, functioning webcam, and microphone.
  6. RON Cancellation and No-Show Policy
    1. Required Deposit: A $12.50 deposit is required to secure your RON appointment. This deposit covers the cost of reserving the notary's time and the third-party identity verification processes used by our platform.
    2. Late Cancellation: If you cancel with less than 2 hours' notice, the deposit will be non-refundable.
    3. No-Show: If you fail to connect to the scheduled session within 10 minutes of the appointment time, the appointment will be cancelled, and the deposit will be forfeited.
    4. Notary Refusal: If the notarization cannot be completed due to the signer's lack of proper ID, failure to pass identity verification (KBA/credential analysis), or inability to communicate clearly, the deposit will be forfeited, as the notary has fulfilled their commitment and incurred costs.

3.8. Mobile Notary Appointment Requirements

If Services are provided via a Mobile Notary Appointment (including Loan Signings), the Client acknowledges and agrees to the following:

  1. Signer Presence & Readiness: All required signers must be physically present at the agreed location with valid ID. Documents must be complete and ready for signature prior to the Notary's arrival.
  2. Location & Safety: The Client shall ensure the signing environment is safe, well-lit, and provides the Notary with an appropriate workspace.
  3. Wait Time: A&C allows a grace period of fifteen (15) minutes for the Signer(s). If the Signer is not ready after the grace period, A&C reserves the right to charge a Wait Time Fee (as detailed in the SOA) or terminate the appointment.
  4. Travel Fee Policy: The Travel Fee is separate from the notarial act fee and is due regardless of whether the notarization is completed (e.g., due to missing ID or incomplete documents).
  5. Non-Refundable Deposit/Cancellation: Any deposit or pre-payment made by the Client is non-refundable if the session is canceled less than two (2) hours prior to the scheduled appointment time and the cancellation is through no fault of A&C Notary Services. This includes, but is not limited to, the signer's inability to produce valid identification or incomplete documents.

3.8. Apostille and Document Authentication Services (Non-Notarial)

If the Client engages A&C for Apostille or Authentication processing:

  1. Service Defined: A&C provides courier and administrative submission services for Apostille or Authentication Certificates issued by the Nevada Secretary of State (or other relevant authority).
  2. Exclusion of Authority: A&C is not the issuing authority and provides no guarantee that the receiving foreign jurisdiction will accept the document.
  3. Fees and Expenses: The Client shall pay A&C’s separate Apostille Service Fee plus all non-refundable State Fees and Shipping Costs incurred by A&C on the Client’s behalf.

4. Compensation and Payment Terms 

 4.1. Fees: The specific fees for each service will be detailed in the corresponding SOA. Fees will include the Nevada statutory fee per notarial act and separate, negotiated service fees.

4.2. Billing: A&C shall invoice the Client upon completion of the Services or according to the terms of the SOA.

4.3. Accepted Payment Methods: A&C Notary Services accepts the following forms of payment: Cash, Zelle, Debit Card, and Credit Card.

4.4. Payment Terms: Payment is due as stated on invoice.

4.6. Late Payments and Legal Action: Should an invoice payment not be remitted within the three (3) calendar days immediately following the stated due date, the Client shall be assessed a late penalty equal to Ten percent (10%) per day on the overdue outstanding balance, commencing on the fourth day.

If the outstanding balance, inclusive of all accrued penalties, remains unpaid for ninety (90) days from the original due date, A&C Notary Services reserves the right to pursue any and all available legal remedies and actions to recover the debt.

5. Confidentiality

5.1. Obligation: A&C agrees to hold all Confidential Information (including document content and signer information) in strict confidence and shall not disclose or use such information except as necessary to perform the Services or as required by law (e.g., valid subpoena).

6. Indemnification and Limitation of Liability

6.1. Indemnification: The Client agrees to indemnify, defend, and hold harmless A&C against any claims, damages, and expenses arising out of the Client's breach of this Agreement or the misuse of the Services provided by A&C.

6.2. Limitation of Liability: A&C's liability for any damages arising out of or related to this Agreement shall not exceed the amount of the fees paid by the Client to A&C under the SOA in question. A&C shall not be liable for any indirect, incidental, or consequential damages.

7. General Provisions

7.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada.

7.2. Entire Agreement: This MSA, together with any executed SOAs, constitutes the entire agreement between the Parties.

7.3. Independent Contractor: A&C is acting as an independent contractor, and nothing in this Agreement shall be construed to create an employer-employee, partnership, or joint venture relationship.
